DMCA Notice and Takedown Policy

ForgeScroll respects intellectual property rights and is committed to complying with the Digital Millennium Copyright Act (DMCA). This policy outlines our procedures for handling copyright infringement claims.

If you believe your copyrighted work has been infringed on ForgeScroll, please follow the procedures outlined in this policy.

What is Copyright Infringement?

Copyright infringement occurs when copyrighted material is used without permission from the copyright holder. Examples include:

  • • Copying substantial portions of copyrighted books or novels
  • • Republishing copyrighted works without permission
  • • Using copyrighted characters or storylines without authorization
  • • Posting full copyrighted materials as your own

Note: Fan fiction, parodies, and transformative works may be protected under fair use. If you believe content falls under fair use, you may file a counter-notice.

How to Report Copyright Infringement

If you believe your copyrighted work has been infringed, please send a DMCA takedown notice to:

Your notice must include all of the following information:

  • • Your full name, address, and contact information
  • • A description of the copyrighted work you own
  • • The specific URL(s) on ForgeScroll where the infringing content is located
  • • A detailed explanation of why you believe the content infringes your copyright
  • • Your statement that you have a good faith belief the use is not authorized
  • • Your statement, under penalty of perjury, that the information provided is accurate
  • • Your physical or electronic signature
  • • Confirmation that you are the copyright holder or authorized to act on their behalf
Our Response to DMCA Notices

Upon receipt of a valid DMCA takedown notice, ForgeScroll will:

  • • Promptly investigate the claim
  • • Remove or disable access to the allegedly infringing content
  • • Notify the content creator of the takedown notice and this policy
  • • Preserve evidence for potential legal proceedings

Timeline: We aim to respond to valid DMCA notices within 10 business days. In urgent cases, we may act more quickly.

Counter-Notice (For Content Creators)

If your content was removed due to a DMCA notice and you believe it does not infringe copyright (or falls under fair use), you have the right to file a counter-notice.

To file a counter-notice, send an email to dmca@forgescroll.com that includes:

  • • Your full name, address, and contact information
  • • Identification of the removed content and its location
  • • Your statement that you have a good faith belief the content was removed by mistake
  • • An explanation of why you believe the use is authorized (e.g., fair use, parody, original work)
  • • Your statement, under penalty of perjury, that the information is accurate
  • • Your physical or electronic signature
  • • Consent to jurisdiction of the federal district court where you reside

After receipt of a valid counter-notice, the content creator will be notified, and the content may be restored unless the copyright holder files a lawsuit within 10 days.

Repeat Infringers

ForgeScroll has a policy of terminating user accounts for users who are repeat copyright infringers. This includes:

  • • Users who have multiple valid DMCA notices filed against them
  • • Users who repeatedly post infringing content after receiving warnings
  • • Users flagged by rights holders as chronic infringers

In cases of blatant or intentional infringement, we may terminate accounts immediately, even for first-time offenders.

False DMCA Claims

Filing false DMCA takedown notices is illegal and can result in serious legal consequences, including:

  • • Civil liability for damages and attorney fees
  • • Criminal penalties under 17 U.S.C. § 512(f)
  • • Account termination

ForgeScroll reserves the right to pursue legal action against users who file false or frivolous DMCA notices with the intent to harm content creators.

Protection for Content Creators

ForgeScroll is committed to protecting original content creators on our platform:

  • • We will enforce copyright protections for all original works
  • • We provide tools for authors to report stolen content
  • • We investigate all reports of content theft thoroughly
  • • Authors keep 70% of earnings from their work
  • • Authors retain 100% ownership and creative control of their content
